1) Acceptance of Terms
These Terms govern your use of our website and telehealth services (the “Service”). If you do not agree, do not use the Service. Precision RX Telemed may update these Terms at any time; updates are effective when posted. Continued use signifies acceptance.
2) Description of Service & Limitations
We connect patients with licensed clinicians for evaluation, possible telehealth visits, and, when clinically appropriate, prescriptions related to erectile dysfunction. The Service does not replace in-person care when needed, and no outcome or prescription is guaranteed.
Availability may vary by state due to licensure, telemedicine rules, and pharmacy shipping laws across the continental USA.
3) Telehealth & Consent
Telehealth may include secure audio/video and electronic communications. Risks include technology failures, incomplete assessment, or miscommunication. By using our Service, you agree to our Telehealth Consent, incorporated here by reference.
4) Disclaimers & No Guarantees
The Service is provided “as is.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. No results, benefits, or prescriptions are guaranteed.
5) Limitation of Liability
To the maximum extent permitted by law, Precision RX Telemed and its affiliates are not liable for indirect, incidental, consequential, special, or punitive damages (including data loss, personal injury, or lost profits) arising from use of the Service.
6) Indemnification
You agree to indemnify and hold harmless Precision RX Telemed, its clinicians, and affiliates from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms or applicable law.
7) Registration, Accounts & User Obligations
Some features require accurate, current information. You are responsible for safeguarding credentials and activity under your account and for promptly updating your information as needed.
8) Intellectual Property
All site content (text, designs, images, logos, and software) is owned by or licensed to Precision RX Telemed and protected by law. You may not copy, modify, or distribute content except as expressly permitted.
9) Refunds & Returns
Telehealth services are non-refundable once rendered. Prescription medications cannot be returned or exchanged once dispensed by a pharmacy.
10) Termination of Service
We may suspend or terminate access at our discretion, with or without cause. Following termination, provisions concerning confidentiality, IP, indemnification, and limitations of liability will survive.
11) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida. Disputes will be resolved in Florida courts or via binding arbitration as allowed by law.
12) Severability, Waiver & Assignment
If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign rights under these Terms; we may assign without restriction.
13) DMCA & Copyright
To report alleged copyright infringement, send a DMCA notice including: (a) your physical/electronic signature; (b) identification of the copyrighted work; (c) identification of the material to be removed; (d) contact info; (e) a good-faith statement; and (f) a statement under penalty of perjury of accuracy and authority. 14) Entire Agreement
These Terms, together with our Privacy Policy and Telehealth Consent, form the entire agreement between you and Precision RX Telemed regarding the Service.
